Terms of Service

1. Conclusion of a contract


With the booking, which can be made verbally, in writing or by email, you offer Ecotrails a binding contract. With the registration (booking) you accept the tour conditions, the basis of the contract are the services mentioned on the website.


The booking contract comes into being through acceptance in the form of a booking confirmation by Ecotrails. The registration is binding by the applicant, also for all participants listed in the registration. The booking person or the group client is liable for all obligations of fellow travelers, in particular the payment of the tour price and cancellation costs for which he / she makes the booking.



2. Payment


The tour price can be set up by prepayment or cash payment on site. Ecotrails does not accept credit card payments and charges fees for PayPal payments. Payment via MBWay is possible.


The prepayment of the full tour price for Groups of over 10 people must take place at least one week before departure. When renting a canoe, material can only be issued if the full amount has been paid in cash on the day of departure or has been credited to our account.


Children who have reached the age of 5 and not yet 15, pay the stated child price. This can only be granted if a maximum of 2 children are accompanied by an adult.

3. Services and changes to services


The scope of the contractual services corresponds to the service description and the price information in the offer on the website. We undertake to inform you immediately about changes / deviations in performance. If necessary, we will offer you a free rebooking or a free cancellation.


After the conclusion of the contract, the customer is not entitled to changes with regard to the tour date, the tour, the place where the tour begins, the accommodation or the type of transport (rebooking). If a rebooking is possible and is still carried out at the customer's request, Ecotrails can charge compensation for the costs incurred.



4. Cancellation, rebooking by the customer


The customer can cancel the tour at any time before the start of the tour. Ecotrails can demand compensation in the form of a flat-rate percentage of the tour price, which is calculated as follows:


Cancellation two days or more before the tour date: 20%

If the customer withdraws one day before the agreed tour date: 50%

If the customer withdraws on the same day: 90%.


The amount of the flat rate is based on the date of the agreed tour and receipt of the cancellation by Ecotrails.



5. Cancellation and termination by the organizer


The tour operator can withdraw from the contract up to the last minute before the start of the tour if special events such as storms, extreme high or low water, environmental disasters etc. would not allow the tour to proceed safely or official instructions require this.


  • if the tour is canceled at least one day in advance, the customer is entitled to the full rental price
  • If the tour has to be canceled on the same day, Ecotrails is entitled to 10% compensation.



6. Liability of the organizer


As part of our due diligence, we are liable for:


  • conscientious tour preparation
  • the proper provision of the contractually agreed services


Participation in our tours involves risks and is at your own risk! In this respect, we are only liable for willful intent and gross negligence. Due to the regulations of the "Turismo de Portugal", we ask you to sign your consent before the tour.



7. Limitation of Liability


Our contractual liability is limited to three times the tour price. We are not liable for service disruptions in connection with services that are only brokered as third-party services.

The performance obligation of Ecotrails results from the content of the booking confirmation.


Equipment

Life jackets are provided and must be worn by all participants on the canoe tour. If participants refuse to wear life jackets, this is done at their own risk. The material must be returned in full and undamaged after the tour. We ask you to sign your consent before the tour.


Duty to cooperate

The customer is obliged to cooperate in the event of service disruptions within the framework of the statutory provisions, to avoid possible damage or to keep it low. In particular, you are obliged to notify us of your complaints immediately on site or to our tour guide. We or the tour guide will provide a remedy if possible. If you fail to report a defect immediately, you will not be entitled to a reduction in price.



8. Ineffectiveness of individual provisions


The ineffectiveness of individual provisions does not in principle justify the ineffectiveness of the tour contract for the rest.
